Rule 31 General Civil and Family Law Mediation
Mediation is a voluntary, informal process during which a third party neutral person, the mediator, assists disputing parties in reaching a mutually acceptable solution of their dispute. During the mediation session the parties identify pertinent issues, clarify misunderstandings, explore solutions to the problem, and negotiate an agreement.
Arbitration is the private determination of a dispute by an independent third party, usually an arbitrator. The disputing parties give the arbitrator the power to decide the dispute. Arbitration is an alternative to court action (litigation), and generally, is final and binding (unlike mediation, negotiation and conciliation which are non-binding, except the signed settlement agreement is enforceable).
